Article 3.14. Administrative ban on visiting venues of official sporting events on the days of their holding

1. An administrative ban on visiting places where official sports competitions are held on the days of their holding consists in a temporary ban on a citizen from visiting such places during the days of official sports competitions and is established for violating the rules of behavior of spectators during official sports competitions. An administrative ban on visiting the venues of official sports competitions on the days of their holding is imposed by the judge.

2. The administrative ban on visiting the venues of official sports competitions on the days of their holding is established for a period of six months to seven years.

On July 23, 2013, Federal Law No. 192-FZ “On Amendments to Certain Legislative Acts of the Russian Federation in Connection with Ensuring Public Order and Public Safety during Official Sports Competitions” was adopted. The law came into force on January 20, 2014.

So, this Federal Law amends the Code of Administrative Offenses of the Russian Federation in terms of restricting attendance at mass sports events.

So article 3.14. The Code of Administrative Offenses of the Russian Federation introduces an administrative ban on visiting the venues of official sports competitions on the days of their holding.

The essence of the administrative ban is that a citizen is temporarily prohibited from attending sporting events for violating the rules of conduct during an official sporting event. On December 16, 2013, the Government of the Russian Federation issued Resolution N 1156 "On Approval of the Rules of Spectator Conduct during Official Sports Competitions." It follows from this resolution for violation of which prohibitions they are subject to legal responsibility.

Throw objects at other spectators or athletes,

Insult others

Hide your faces

Carry out actions that pose a threat to their own safety, life, health, as well as the safety, life, health of other persons.

The decree of the Government of the Russian Federation also contains a list of items that are prohibited from being carried on sports objects and use them there. These items include:

Weapons, ammunition, stabbing or cutting objects, flammable and pyrotechnic substances, including signal flares, flares, firecrackers, gas cylinders and objects (chemical materials) that can be used to make pyrotechnic products or fumes;


Wind devices for producing sounds (including vuvuzelas), with the exception of horns and pipes;

Alcoholic drinks of any kind

Narcotic and toxic substances or stimulants,

Soft drinks in glass or tin containers, as well as in plastic containers with a volume of more than 0.5 liters,

Propaganda materials of an extremist nature or containing Nazi attributes or symbols, or attributes or symbols of extremist organizations.

As for the use of support means by fans, in this regard, the Rules state that banners and flags, the carrying of which to the venues of sports competitions does not require approval from the organizer of the official sports competition, should not exceed the dimensions of 2 meters by 1.5 meters, including number on hollow shafts not exceeding 1.5 meters in length and 2.5 centimeters in diameter. Moreover, if they contain an inscription on foreign language or the language of the republics of the Russian Federation, the translation into Russian must be certified by a notary or by the organizer of the sports competition.

An administrative ban on visiting the venues of official sports competitions on the days of their holding is appointed by a judge and is established for a period of six months to seven years.

Part 1 article 20.31. The Code of Administrative Offenses of the Russian Federation provides for liability for violation of the rules of behavior of spectators during official sports competitions and entails the imposition of an administrative fine in the amount of three thousand to ten thousand rubles or compulsory work for up to one hundred and sixty hours with the imposition of an administrative ban on visiting the venues of official sports competitions on days their holding for a period of six months to three years, or without it.

Part 2 of Article 20.31 of the Code of Administrative Offenses of the Russian Federation provides for liability for the repeated commission of an administrative offense provided for in Part 1 of Article 20.31 of the Code of Administrative Offenses of the Russian Federation, or the commission of this offense, which entailed the suspension or termination of an official sports competition and entails the imposition of an administrative fine in the amount of ten thousand to fifteen thousand rubles or administrative arrest for up to fifteen days with or without an administrative ban on visiting the venues of official sports competitions on the days of their holding for a period of six months to seven years.

Consideration of cases on these offenses in accordance with Part 3 of Article 23.1 of the Administrative Code is attributed to the competence of justices of the peace.

The internal affairs bodies keep records of persons who have been assigned an administrative ban in order to ensure the execution of the decision on the administrative ban on visiting the venues of official sports competitions on the days of their holding.

During the period of official sports competitions in order to prevent persons subject to an administrative ban from entering the places of their holding, while performing service, both at sports facilities and in the adjacent territory, employees of territorial bodies of internal affairs when checking identity documents of citizens in the cases stipulated by the Federal Law "On the Police", citizens are checked for whether they have an administrative penalty in the form of an administrative ban.

In addition, the legislator provides for the procedure for the organizers of official sports competitions to receive a list of persons and the right of controllers-managers involved by the organizers of official sports competitions and (or) owners, users of sports facilities to ensure public order and public safety, not to allow persons to enter the venue of these competitions, in respect of which a court ruling on an administrative ban came into force.

In the event that a sports competition being held is included in the decision of the Government of the Russian Federation, according to which the identification of spectators at the entrance to the venue is mandatory, then, in accordance with the Rules of Conduct for Spectators during Official Sports Competitions, it is the responsibility of spectators to present a document proving the identity of the spectator. and controllers-administrators take measures to prevent persons subject to an administrative ban from entering the competition venues by comparing the installation data of incoming citizens with the List of Persons.

When a person is identified, in respect of whom an administrative ban has been established directly at the venue of the competition (when suppressing an offense or identifying his personality under other circumstances, including with the help of technical means), an administrative case is initiated against this person under part 5 of Article 20.25 of the Code of Administrative Offenses of the Russian Federation (for violation of an administrative ban on visiting the venues of official sports competitions on the days of their holding, it entails the imposition of an administrative fine in the amount of twenty thousand to twenty-five thousand rubles or administrative arrest for up to fifteen days).

But this is all in theory. How this law will be implemented in practice, only time will tell. Indeed, in reality, the law "on fans" has many gaps. And it is not yet known whether a new law was needed or it was possible to use the old, but clearly executed. In any case, it is ripe a big problem, which the legislator decided to allow in this way. We hope that over time this will help bring peace and order back to the stadiums.

1. The decision on the administrative ban on visiting the venues of official sports competitions on the days of their holding must be executed by a person brought to administrative responsibility.

2. The federal executive body in the field of internal affairs maintains a list of persons who have been assigned the type of administrative punishment specified in part 1 of this article in order to ensure the execution of the resolution on an administrative ban on visiting the venues of official sports competitions on the days of their holding (hereinafter - the list of persons ).

3. The entry of information into the list of persons is carried out by the federal executive body in the field of internal affairs no later than three working days from the date of receipt of a copy of the effective resolution on the administrative ban on visiting the venues of official sports competitions on the days of their holding.

4. A person is considered excluded from the list of persons upon the expiration of the period of an administrative ban on visiting the venues of official sports competitions on the days of their holding or in the presence of a judicial act that has entered into force in the federal executive body in the field of internal affairs on the abolition of the decision on an administrative ban on visiting places holding official sports competitions on the days of their holding.

5. The exclusion of information from the list of persons is carried out by the federal executive body in the field of internal affairs not later than three working days following the expiration date of the administrative ban on visiting the venues of official sports competitions on the days of their holding, or not later than three working days from the date of receipt a copy of a judicial act that has entered into force on the cancellation of the decision on an administrative ban on visiting the venues of official sports competitions on the days of their holding.

6. Information contained in the list of persons (last name, first name, patronymic (if any), date and place of birth of the person in respect of whom the court decision on an administrative ban on visiting the venues of official sports competitions on the days of their holding entered into force, date and the number of the court decision on an administrative ban on visiting the venues of official sports competitions on the days of their holding, the dates of the beginning and expiration of the period of administrative punishment), are open to public knowledge.

Types of sports competitions by level and purpose

Types of sports competitions according to the form of organization and form of offset

1. This measure, as a type of punishment, was introduced by the Federal Law of 23.07.2013 N 192-FZ. In accordance with the Order of the Ministry of Sports of Russia, the Main Directorate for ensuring the protection of public order and coordination of interaction with the executive authorities of the constituent entities of the Russian Federation of the Ministry of Internal Affairs of Russia maintains a list of persons who are prohibited from visiting the venues of official sports competitions on the days of their holding.

The basis for entering information into the list of persons who are prohibited from visiting the venues of official sports competitions on the days of their holding is a decision that entered into legal force in the case of an administrative offense under Art. 20.31 of the Administrative Code.

During the period of official sports competitions, in order to prevent persons subject to an administrative ban from entering the places of their holding, while performing service, both at sports facilities and in the adjacent territory, police officers are guided by identifying these persons and carrying out preventive measures with them. measures aimed at preventing violations of administrative legislation

When identifying on the territory adjacent to the venue of the competition, persons in respect of whom an administrative ban has been established, together with the controllers, police officers take measures to prevent these citizens from entering the sports facility.

If a person is identified against whom an administrative ban has been established, an administrative case is initiated against this person directly at the venue of the competition under Part 5 of Art. 20.25 of the Code (for violation of the administrative ban on visiting the venues of official sports competitions on the days of their holding).

2. An administrative ban on visiting the venues of official sports competitions on the days of their holding may be imposed by a judge as both the main and additional administrative punishment and consists in a temporary ban on a citizen from visiting such places on the days of official sports competitions and is established for violation of the rules of conduct spectators during official sports competitions. Violation of an administrative ban entails the imposition of an administrative fine in the amount of 20,000 to 25,000 rubles or administrative arrest for up to 15 days.

In order to stop small and large clashes between fans and the police in the summer of 2013, federal legislation introduced rules related to a new type of responsibility for actions performed by fans under the influence of emotions.

An administrative ban on visiting the venues of official sports competitions is understood as the lack of admission to a citizen of the stadium if he went beyond the permitted norms of spectator behavior.

The measure is temporary and lasts from six months to 7 years- depending on the frequency of the offense and its consequences.

The ban on watching live idols' competitions is regulated by several articles of the Code of Administrative Offenses of the Russian Federation:

  • 3.14 - the definition of the measure of punishment has been introduced;
  • 20.31 - its application has been clarified;
  • 20.25 - liability for insubordination is provided.

Who can it be applied to?

The administrative ban on visiting the venues of official sports competitions is a limiter for fans who are overly heated by ups and downs.

The mechanism of its application has a specific regulatory and legal basis - the Rules of Spectator Conduct during official sports competitions, approved by the Decree of the Government of the Russian Federation of December 16, 2013 No. 1156.

According to this act, spectators at the stadium are prohibited from:

  • come drunk or bring "intoxicating" liquids with you;
  • throw foreign objects at people around or insult them;
  • be in masks covering their faces;
  • perform other body movements that pose a threat to the safety of other spectators and athletes.

A fan who has brought objects prohibited by this Resolution to the competition can also be punished. In addition to common illegal goods such as weapons, drugs and explosives, objects that, if desired, can be turned into a tool for expressing negative emotions, are also prohibited: glass, tin and plastic containers, various "loud" devices for sound effect. Even flags and banners have size limitations.

  • The cloth should be 2 x 1.5 m in size.
  • Hollow shafts are allowed with a height of up to one and a half meters and a diameter of less than 2.5 cm.
  • If there is an inscription in a language other than Russian, you will need to present a notarized translation.

Who appoints?

According to the norms of administrative law, cases of inappropriate actions of fans and the application of a measure of responsibility to them, in the form of deprivation of the pleasure of contemplating official championships and tournaments in their places, are subordinate to justices of the peace.

When detecting cases of inappropriate behavior of fans, police officers draw up a protocol on an administrative offense on the part of the guilty person. 1 or 2 of article 20.31 of the Code of Administrative Offenses of the Russian Federation.

The materials of the case are considered in the magistrate's court, where the final punishment is determined. For hooligans caught for the first time, it is permissible to use such measures as payment of a fine of 3000-10000 rubles or correctional labor up to 160 hours, as well as with the imposition of a ban on attending competitions for a period of six months to 3 years, or without it.

If the violation was committed again or became the reason for stopping the competition, then such malicious violators of public order are already threatened a fine of 10-15 thousand rubles or 15 days in the nearest temporary detention center.

When deciding to impose a ban on visiting sports facilities, the judge has the right to increase the term of this punishment up to 7 years.

To verify compliance with this measure, controllers at the entrance have the right to request, in addition to tickets, an identity document, and to conduct a reconciliation with the list of exposed administrative punishment persons.

For the same purpose, before the start of the competition, police officers can also check the identity of the fans using their passports and the presence of information about them in a kind of black list.

Identification of the offender entails a punishment for him in the form fine from 20 to 25 thousand rubles or administrative arrest for 15 days.

Is this measure applied in practice?

On May 27, 2014, by the decision of the magistrate of Saransk, two Tula women were banned from attending the events for six months.


In addition, the men were also fined: one - 4 thousand rubles, the other - 5 thousand. Their fault consisted in the use of fireworks at the Saransk stadium, where the match between the home team and the Tula "Arsenal" took place.

On July 26, 2015, a fan from Adygea was detained, who lit a fire at the Kuban stadium. His actions are qualified by part 1 of article 20.31 of the Code of Administrative Offenses of the Russian Federation with the imposition of a fine or correctional labor and the possible application of a ban on observing the real matches of his team.

Time will tell whether the application of such a measure as an administrative ban on visiting the venues of official sports competitions will reduce the emotional "degree" of fans.

In the meantime, the police have been charged with identifying violators among the fans. The "hotheads" draw up a protocol on an administrative offense, which is considered in the magistrate's court at the venue of the competition.
